Bought 2 5800 phones directly from nokia usa..no support whatsover... still no v4.0 f/w when it is avail. everywhere else.. also my n97 is piece of **bleep**.. i dont use it at all use i8910 instead. what a waste of money.. never wll buy another nokia product.

Uh, how can you sue Nokia for breach of contract wherein your contract with Nokia says nothing about them requiring to give you firmware updates?
it doesnt matter either if you bought it from Nokia USA or not. If the unit is a country variant and the telecommunications bureau of the country still has not approved the release of the firmware for your product code, there's nothing you nor Nokia can do about it.

you are full of **bleep**.. there is no process that needs to be done for new f/w releases.. fcc or no one has to approve it.. That is only for new h/w.

Well in other countries there is. Especially in countries like China where the phones are strictly regulated. All country variant phones have this "blocking".
Anyway, may I ask what contract would you sue Nokia for? AFAIK there is no single clause in any contract which says they are required to give you firmware updates. They can just not give firmware updates in the first place if they wanted to do that. So whatever evidence you do have, you still havent got a case.

well dont be so sarcastic.. i already got my money back for my n97.. filed claim with american express after 5 repair attempts and the gps was still unuseable.. it sits on my shelf unused.. i now use a i8910.. at least the 5800's and my wifes n85 have a usueable gps.. and no design flaws such as gps and camera lensas with the n97.. but i will never buy another nokia after buying over 10 nokia phones.. they have let me down.. their support is not up to par anymore.. especially when they release faulty products such as n97 and refuse to admit it.. and then also refuse to support their phones inthe u.s. such as lack of f/w updates.. my next phone will be an android..probably nexus one when it comes out for att variant.

The i8910 (Omnia HD) is cool...basically like 5800 on crack.
Anyway, personally I'd prefer WinMo over the Android.
I would not ask you to reconsider Nokia, however what I would tell you is to never buy phones without first waiting for three months after the release and researching for reviews, comments, complaints, and issues. Basically that is the reason why some people (like me and a few people I know) manage to avoid things like what you experienced. Later factory batches will always work better than the first batch, no matter what brand or make.
