The N97 Mini doesn't seem to be on the supported devices list yet, so it might not be available:

http://iplayerhelp.external.bbc.co.uk/help/mobile/mobile_phone

You will have to be on wi-fi to download programs, at any rate, so please check that you're connecting that way.
