NOKIA CALL ENDING REFUND UNDER SALES OFF GOODS ACT

I am after a refund or exchnage as my nokia 800 does not work correclty I can not end calls.

 

This is a primary function off a mobile phone to be able to hang up.

 

As I can not do this I would like a refund or a exchanged to a smartphone that works.

 

Please advise.

Your contract under the Sales of Goods Act is with the vendor, hence, the vendor should be your first point of contact.

I have contacted them they say it is manufactures fault and has been sent to Nokia for repair. It is still at nokia at the moment.

From reading the threads on here it appears there is no fix.

When you get the phone back if it still isn't working for you then you need to contact Nokia care. Ask to speak to someone who can take your complaint, if no one is available ask for the official complaints address. Send them a constructive letter (recorded delivery if possible) and they will reply to you.

Unfortunately this is not something that can be resolved through this forum.

The ending calls thing would bug me and I imagine that can fixed through software updates. The battery thing in the last post though... 8-10 hours is normal. Its not a basic phone. If you put heavy use through a smartphone for 3 hours its normal for 50% of the battery to drain. Just wait for the newest update which is meant to improve an already average battery life.

I argree totally with you.

Until the issues have been rectified these phones should be pulled from the shops.Or at least all the shops selling these should be highlighting these issues to the customers.

 

I am in the process off getting a refund and I will never buy Nokia ever again.

I'm not disputing the fact that the phone does not give the battery life promised as I agree with you on that. I'm just saying that other high end phones out there also last 8-10 hours. Although all those things on your phone were turned off I imagine your mobile network 3g signal was on and I imagine you had live tiles updating. Oh and I don't work for Nokia anywhere in the world.

Assuming you are talking about the UK, if this problem existed from the outset then your consumer rights entitled you to a full refund from the vendor who sold you the phone as it is 'not fit for purpose'. As previously stated by another poster, your contract is with them and not with Nokia.

 

 Unfortunately however, it now sounds like you have de facto 'agreed' to a repair and so I fear you may have inadvertently waived your rights of refund under SOGA - but check with Trading Standards and/or Citizens Advice as the situation may be recoverable.
